US Ban on Kinder Surprise Eggs Finally Lifted (Kinda)

The United States' most notorious food ban is finally being lifted.

Kinder Surprise eggs, an Italian brand of egg-shaped chocolate candies containing a toy "surprise" inside, have been banned in the States since long before they were first manufactured in the early '70s.

That's because the US has had a ban on candies with embedded toys since 1938.

The confection also runs afoul of a law requiring all toys that accompany candies to be safe for children of all ages (the toys contained in the eggs are labeled as being safe for ages 3 and up).

Nevertheless, Kinder eggs remain highly popular in America, and citizens regularly attempt to smuggle samples into the country despite a potential fine of up to $2,500 per egg.

In an effort to save thousands of candy mules from having to regularly stuff chocolate eggs up their rectum, a New Jersey-based company has come up with an ingenious way of making Kinder eggs entirely legal.

Choco Treasures are different. First off, each of the three different editions of Choco Treasure has its own collection of all ages toys, from the original chocolate eggs to sports balls to even a Spider-man-inspired egg, licensed from Marvel. Second, each egg features a specially-designed capsule that separates the two halves of the chocolate so even a small child can see the there's something on the inside.

Choco Treasure eggs will be hitting shelves across the country just in time for Easter.

Fans of the original product have plenty to gripe about: The toys are rather mediocre and the chocolate is a fry cry from Ferrero's world-class white-on-black goodness, but it's a start.

And for a country that has a ban on chocolate eggs, it's about as good a start as you're likely to get.

US ban of Kinder eggs cracked at last

Children of America, rejoice! After a decades-long wait, a US company has finally come up with a way to sell Kinder Surprise-style toy-filled chocolate eggs in the country, sidestepping a 1938 ban on inedible toys being placed inside sweets with a new design.

The ban, which is meant to protect children from swallowing the plastic toys masked by the chocolate shells, also prohibits the import of Kinder-style sweets. Over the years, US officials are reported to have seized thousands of the treats, which can attract fines running into hundreds of dollars at the American border.

But Kevin Gass, who runs the New Jersey-based Candy Treasure, has now found a way around the prohibition. In his version, the toy is cased in a plastic capsule with a thick ridge that separates the two hollow chocolate halves. For American regulators, the ridge, which is visible when the foil covering the sweet comes off, serves the purpose of warning children that there is something hidden inside the chocolate. As an added precaution, the toys are also larger than the ones found inside foreign versions, according to ABC News.

A long-standing online petition addressed to the US Congress and digitally signed by more than 3,000 people asks US lawmakers to “help us restore the Ferrero Kinder Egg to shelves in the United States. This small matter can bring joy to millions of American children.”

Why are Kinder Surprise eggs illegal in the US?

I actually used Kinder Surprise eggs as a case study in a masters paper. To answer the legal question, the 1938 Food, Drug and Cosmetic Act is the law most cited to justify the embargo on Kinder Eggs. Because a toy is kept inside a confection, Kinder eggs are embargoed from point of entry into the US.

As someone who has given Ferrero Kinder eggs to my children while living in Europe, I can state that for a child over the age of three, these eggs are perfectly safe. The capsule holding the toy is too large for a small child to swallow, and is almost impossible for adults, let alone children, to open easily. Plus there are plenty of warnings on the foil packaging advising parents not to give the confection to children under the age of three.

While conducting research on this paper, I discovered that Mars actively lobbied the US government to have confections with interior toys banned any time a similar product comes on the market. For instance, in 1997, when Nestlé tried to introduce (the similar) Magic chocolate balls in the US, Mars was instrumental in promoting civil action to prevent the marketing of this product.

And believe me, getting caught trying to 'smuggle' Kinder eggs into the US is not much fun. We had friends travelling into the US from Canada who packed 10 Kinder eggs in their luggage for their children (all over the age of five) for Easter. Customs and Border Protection not only confiscated the Kinder eggs, but also fined the family $1,200 [£787] per egg, or $12,000 [£7,870] total. So, don't try this, unless you're willing to pay a hefty price.

As already written, US regulation does not allow placing a 'non-food' object inside food, but only if it is not visible from the outside.

But there is a similar product available that copies the Kinder Surprise egg but dodges the US regulation: the capsule containing the surprise is partially visible between the two chocolate halves.

If security is the goal we want to reach we should start considering banning hot dogs, salted peanuts and all the foods (many of which are man-made) that cause hundreds of choking deaths worldwide.

Not all eggs are created equal in the eyes of U.S. Customs and Border Protection.

Kinder Eggs, a popular European chocolate egg that contains a toy inside, is banned from importation into the United States because it contains a “non-nutritive object embedded in it.”

With the Easter holiday around the corner, the agency issued the reminder this week, warning that the candy is considered unsafe for children under 3. Last year, Customs and Border Protection seized 25,000 of them in 1,700 incidents.

The hollow egg, which is sold by the Italian confectioner Ferrero, is available in Europe, Canada, Australia and parts of Latin America under various names including Kinder Surprise and Kinder Sorpresa. It has taken on a cult status among adults who collect the toys, which vary from rings to animals and cartoon characters.

Kinder Eggs’ scarcity in the United States has made them an object of desire: Various websites and online forums are dedicated to acquiring them.

Some are apparently hiding in plain sight. Earlier this week, DNAinfo.com, a New York City neighborhood guide, posted a story and slideshow showing stores where the coveted treats can be found.

“While there are some commercial-sized seizures that occur, most Kinder Eggs are seized in personal baggage or at mail and express consignment facilities,” Customs and Border Protection said.

A Canadian woman reportedly learned her lesson the hard way.

The woman was selected for a random search at a border checkpoint in Minnesota when officials discovered she was carrying a Kinder Egg and took it from her, The Toronto Star reported.

A few weeks later, she received a 7-page letter asking if she wanted the egg back or if she was going to abandon rights to it, the Star reported.

“I was in disbelief,” she told the newspaper. “It’s a $2 egg.”

I am 15. I used to live in Germany where Kinder Eggs were a big hit, after coming back to the States I realized that I could not find them ANYWHERE. I had to have a friend send them to me from Germany but she then moved to the States as well. I see no fit reason for them to be banned. OTTAWA — U.S. authorities are urging Canadians to stop sending Kinder Surprise chocolate eggs to that country as gifts this holiday season because of a long-standing ban on the product south of the border.

A spokesman for U.S. Customs and Border Protection says officers noticed a spike in the lead up to Christmas this year, so are hoping the alert will reach Canadians who don't know the ubiquitous product in Canada is actually banned in the U.S.

"It's mostly personal amounts going down as a gift," Chris Misson, a spokesman for U.S. Customs, said Thursday. "This is an informational thing to make people are aware that they don't lose the Kinder eggs at the border."

The U.S. Consumer Product Safety Commission determined years ago the product did not meet the small-parts requirement for toys for children under the age of three, creating a choking and aspiration hazard in young kids.

As a result, Kinder Surprise eggs are banned for sale and import into the U.S.

Health Canada has a different take on the product, available in Canada since 1975 and especially popular at Easter and Christmas, when the Ferrero Group manufactures themed treats.

The Kinder Surprise, deriving its name from the German word for children, has always been legal here because Health Canada has determined the tiny toy inside is not likely to be used by children under three years of age.

As a result, "the requirements for small components do not apply to the product," Health Canada said in a statement.

Health Canada determined infants and toddlers don't use the tiny trinket inside the Kinder egg based on a number of factors, including the manual dexterity required to open the plastic egg that holds the toy and the complexity of the toy design itself.

The toys, smaller than the size of an eraser, could be a 3-D puzzle, have multiple small pieces or small stickers for application.

Meanwhile, the outer wrapping on the product carries the international choking hazard symbol for toys. There's also a warning in bold that reads: "Toy not suitable for children under three years. Small parts might be swallowed or inhaled. Adult supervision recommended."

Mark Wakefield, vice-president of marketing at Ferrero Canada, said Kinder Surprise is a hit with consumers because it's a great product.

"Kinder is a well-loved brand. The Kinder egg and its toy have been enjoyed by adults and children for more than 35 years in countries including Canada, Mexico, Italy, France, Germany, Australia and the United Kingdom," he said in a statement Thursday.

The Kinder Surprise was first launched in Italy in 1972, but Ferrero Group has never been able to sell the product in the United States.

In 1993, the company asked U.S. authorities to permit its sale, but the government turned down the request, citing regulations that prohibit having an inedible product inside an edible object.

Ferrero Canada, which also distributes Ferrero Rocher, Nutella, Tic Tac and Kinder Surprise in Canada, also offers a special Kinder Surprise Maxi, available only at Easter, and the Kinder Christmas Ball.

Bringing Kinder Surprise eggs into the US can incur a fine of hundreds of dollars because the famous chocolates with toys inside are illegal there under a 1938 law. Seizures of the eggs have doubled since 2010, but egg-lovers are now petitioning for the ban to be lifted.

People travelling to the US would be well advised to refrain from taking Kinder Surprise eggs with them. The chocolate eggs are illegal in the US because of a law dating back to 1938 which bans inedible objects inside confectionery. There are concerns that small children could choke on the mini-toys found inside the eggs.

The law predates the Kinder Surprise eggs made by Italian company Ferrero but people caught entering the US with them in their luggage risk incurring a fine of several hundred dollars. Last year, customs officers fished 60,000 of the eggs from people's luggage, more than twice the number seized in 2010.

Several thousand US citizens have responded by launching online petitions demanding that the ban on the eggs be lifted. Ferroro couldn't be reached for comment.

Keeping Easter Safe

American officials have, in recent years, proven to be particularly vigilant in keeping the eggs ova non grata in the US. A 2008 press release issued by US Customs and Border Protection, part of the Department of Homeland Security, announced the finding of dozens of such eggs at JFK airport in New York just prior to Easter that year.

"The vigilance of our CBP officers at the mail facilities has prevented these potentially dangerous toys from ending up in children's Easter baskets," crowed Leon Hayward, CBP acting director of field operations, at the time. "We will continue to keep our guard up to stop harmful products from entering the United States."

On Good Friday, a holiday celebrated by many Americans, Moms Demand Action is hand-delivering Kinder Surprise Eggs to newsrooms in major cities to relay an alarming truth: In America, it’s easier to access an assault weapon than a chocolate Easter egg.

Kinder Surprise Eggs have been banned in America since 1938 due to a law prohibiting inedible objects inside food, which could pose a hazard to young children.

“During Easter weekend, Moms Demand Action is asking all Americans to use ‘gun sense’ when answering one simple question: ‘Why is it easier for an American to buy an assault weapon than it is to buy a chocolate Easter egg?,’” said Shannon Watts, founder of Moms Demand Action for Gun Sense in America.

“It doesn’t make sense that a chocolate Easter egg is regarded as more hazardous to our children’s safety than an assault weapon. The majority of Americans support common sense gun laws. And as Congress prepares to return to Washington, we need to put this reality into a context that people can understand,” said Watts.
